Incapacity Benefits

Incapacity benefits reassessment process informationAre you receiving Incapacity Benefit, Income Support because you have an illness or disability, or Severe Disablement Allowance?

From this month, as part of the welfare benefits system reforms, the Department for Work and Pension is to start reassessing the claims of people who are receiving these benefits to see if they are eligible for Employment and Support Allowance.

People living in Aberdeen and Burnley will be the first to have the checks. Assessment on claimants living in the rest of the United Kingdom will start in February 2011.

After the assessment, depending on your circumstances, you may move on to the following benefits:

  • Jobseeker's Allowance (JSA) if you are capable of work
  • Employment and Support Allowance (ESA) (work related activity group) if you need more support while you prepare for work
  • Employment and Support Allowance (ESA) (support group) if you are severely disabled or terminally ill. You will not be expected to look for work
  • Income Support or Pension Credit if you satisfy the conditions.

You will not be affected if:

Jobcentre Plus will be in touch with you well ahead of your reassessment and in the meantime there is no action you need to take.

You will continue to receive your current benefit, as long as you meet the conditions of entitlement, until Jobcentre Plus have completed the reassessment.

Re: Incapacity Benefits
Your CPN could be talking about several benefits.

See our information sheet on benefits for people with mental health problems for the type of benefits that you might be able to claim - link below: http://www.turn2us.org.uk/information__resources/benefits/mental_health_problems.aspx

A expert benefits adviser could advise you further on your particular circumstances. You can find a local one using our Find an Adviser tool - link below

Re: Incapacity Benefits
You cannot make a new claim for Incapacity Benefit as this benefit has been replaced by Employment and Support Allowance.

To find out what benefits you might be entitled to use our benefits checker - http://www.turn2us.org.uk/benefits_search.aspx

To find out more about benefits for people who are sick or disabled, see http://www.turn2us.org.uk/information__resources/benefits/sick_or_have_a_disability.aspx

Turn2us cannot advise on individual circumstances.  This is a complicated issue and we recommend you get advice from an expert benefits adviser.  You can use our Find an Adviser tool to find a local one.

You might also find it helpful to look at the website of the following mental health charities or ring their helplines:

Mental Health Foundation (link opens in a new window)

Provides information and supports people with mental health problems

MIND (link opens in a new window)

Supports people living with mental health problems. This includes information on mental health and money matters (link opens in a new window).

Re: Incapacity Benefits
i too have Borderline personality disorder but i also have ocd, menieres(causing deafness and sudden vertigo)and ptsd. will i be expected to prove i can stand up etc.. on 'good' days i am functional but on a bad day i could have a serious menieres episode making me unable to sit up.on a bad BPD day i behave in a manner contrary to safe working.infact i am on very strong meds.finally, i am recently diagnosed diabetic.
Re: Incapacity Benefits
I have multiple disabilites including BPD, and ME. I'm also concerned regarding these new benefit medicals; but have since seeked advice from my local Unemployed Workers Centre. Most towns etc have places to offer advice regarding benefits rights. I only get 'reviewed' every three years by the DWP.
